Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.

Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die Waren in Besitz genommen haben bzw. hat.

Um Ihr Widerrufsrecht auszuüben, müssen Sie GLYK (Christoph Balduin Stroppel, Richard-Wagner-Straße 22, 99423 Weimar, hallo@GLYK-musik.de, Telefon: 01702075113) mittels einer eindeutigen Erklärung (z.B. ein mit der Post versandter Brief oder E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist.

Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.

Folgen des Widerrufs

Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet. Wir können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben oder bis Sie den Nachweis erbracht haben, dass Sie die Waren zurückgesandt haben, je nachdem, welches der frühere Zeitpunkt ist. Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen vierzehn Tagen ab dem Tag, an dem Sie uns über den Widerruf dieses Vertrags unterrichten, an uns zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der Frist von vierzehn Tagen absenden.

Sie tragen die unmittelbaren Kosten der Rücksendung der Waren.

Sie müssen für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.

Withdrawal By You From The Contract (CDs and Merch).

1. You may withdraw your order for goods at any time up to the end of the seventh working day after you make your order even if you have then already received the goods. You do not need to give GLYK any reason for withdrawing your order nor will you have to pay any penalty.

2. The only circumstances in which you cannot withdraw your order are where you have taken the goods you have ordered (or the ones in relation to which you want to withdraw) out of the sealed package in which they were delivered.

3. To withdraw your order you must notify GLYK in writing at the address in the contact section of this website.

4. If you have received the goods before you withdraw your order then, unless you have lost your right to withdraw because you have taken the goods out of their sealed package, you must send them back to the GLYK contact address at your own cost and risk. If you withdraw your order but GLYK has already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to GLYK at the GLYK contact address at your own cost and risk as soon as possible.

5. Once you have notified GLYK that you are withdrawing your order, any sum debited to GLYK, excluding shipping costs if the order has already been dispatched, will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by GLYK in the condition they were in when delivered.

Liability. This is as follows:
1. If the goods GLYK delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, GLYK shall have no liability to you unless you notify GLYK in writing at the GLYK contact address of the problem within 10 working days of the delivery of goods in question.

2. If you do not receive goods ordered by you within 30 days of the date on which you ordered them, GLYK shall have no liability to you unless you notify GLYK in writing at the GLYK contact address of the problem within 40 days of the date on which you ordered the goods.

3. If you notify a problem to GLYK under this condition and provided that you chose and paid for registered or insured shipping, GLYK only obligation will be, at its option:- to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question in whatever way GLYK chooses.

4. GLYK will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to GLYK under this condition and GLYK shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under the paragraph above.

5. Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit GLYK liability to you for any death or personal injury resulting from its negligence.

Force Majeure
GLYK shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Invalidity
If any part of these conditions is unenforceable (including any provision in which GLYK excludes its liability to you) the enforceability of any other part of these conditions will not be affected.

Governing Law
The contract between us shall be governed by and interpreted in accordance with German law, and the German courts shall have jurisdiction to resolve any disputes between us.

Entire Agreement
These terms and conditions, together with the current GLYK website prices, delivery details and GLYK contact details, set out the whole of our agreement relating to the supply of the goods to you by GLYK. These terms and conditions cannot be varied except in writing signed by a director of GLYK. In particular nothing said by any sales person on behalf of GLYK should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by GLYK. GLYK shall have no liability for any such representation being untrue or misleading.
